What is process of patent registration in Delhi?

Indian Patent Office (IPO) in Delhi follows a predefined set of rules, regulations or procedure for receiving the patent applications, granting or rejecting patents. This blog guides individuals and companies with the entire procedure of getting an invention patented in Delhi, India.
The patent registration process begins with filing an application in the Indian Patent Office. An application for an early publication requests can also be filed to expedite the patent examination process.
If an early publication request is filled, then the application is likely to be published by the office within a week from the date of receiving the request. Or, if the request is not filled then the application would be published after 18 months from the priority date (the date of filing an application).

Then, the second step is to file a request for examination within 48 months from the priority date. It is recommended to hire a legal advisor in Delhi, if you don’t know how to file a request for examination.
Upon receiving the request for examination, the IPO evaluates the application to find if it satisfies all requirements, if yes, then a patent would be granted. And, if the application does not meet the standards, then, a First Examination Report (FER) is issued.
An applicant is advised to respond to the FER as soon as possible within the period of 12 months from the date of issuance. If, the IPO is not convenience with the same, and rejects it, then, an appeal against the decision can be filed with the Intellectual Property Appellate Board (IPAB).
